HEAD OF DISPUTE RESOLUTION

SIDREC is a one-stop independent dispute resolution centre for disputes involving monetary claims relating to capital market products and services. We were set up under the Capital Markets and Services (Dispute Resolution) Regulation 2010 to provide free, fair and expert help to retail investors and capital market intermediaries.

We are looking for a Head of Dispute Resolution to, among others, lead the management of cases through the complete dispute resolution cycle to ensure that cases are handled in a timely and professional manner.

Our requirements for the position are as follows:

Job Description
  • Lead the management of cases through the complete dispute resolution cycle to ensure that cases are handled in a timely and professional manner, including but not limited to: 
    • Overseeing the work of SIDREC’s dispute resolution team throughout the complete cycle of SIDREC’s dispute resolution process, including the work of the Secretariat to SIDREC Appeals Committee
    • Conducting mediation of cases
    • Adjudicating and issuing of awards
    • Escalating areas of concern to the CEO, including case management matters that may require the CEO’s intervention and any potential gaps in SIDREC’s purview and procedural framework
    • Overseeing the referral of complaints not within SIDREC’s purview by the case management / dispute resolution team to the relevant authorities (if any) in a timely manner and which is within the knowledge of SIDREC
    • Overseeing the maintenance of SIDREC’s case management database
    • Providing senior support to SIDREC’s Panel of Mediators and Adjudicators, including monitoring/overseeing the renewal of the Panel
  • Lead the capacity building efforts of SIDREC’s case managers, including but not limited to developing and implementing an enhanced competency framework for case managers as well as relevant training programmes and modules in support of the enhanced competency framework
  • Lead the management of SIDREC’s corporate and company legal and secretarial affairs, including but not limited to the choice of external lawyers whenever necessary and providing the necessary control and supervision over them as and when required
  • Lead the research and preparation of dispute resolution related reports/papers, including but not limited to preparing and/or revising the dispute resolution procedure manual, reports/papers that relate to SIDREC’s claims and enquiries and that ensure the relevance and effectiveness of SIDREC’s purview, rules and regulations and dispute resolution related policy or position papers
  • Provide the CEO with support as regards SIDREC’s overall administration, research, policy development and implementation initiatives, and preparation of reports/papers including but not limited to: 
    • Contributing to engagements with regulators on matters relating to dispute resolution, and overseeing any reporting requirements in this regard
    • Undertaking research and/or provide input on dispute resolution matters and legal related matters as required by CEO
    • Preparing papers that are relevant to the job function to the Board and Board Committees
  • Provide support to the awareness efforts of SIDREC, in particular on the engagement with various stakeholders, including in the preparation of SIDREC’s Annual Report
  • Undertake such other assignments/projects as may be instructed by the CEO from time to time, including contributing to any special projects that are being periodically managed by SIDREC

Job Requirement: Qualification and Experience

  • A strong law degree from a recognised university and relevant professional qualification. Certification in mediation, adjudication and/or arbitration would be an advantage
  • Solid working experience in legal practice and/or in the capital market with exposure to dispute resolution functions and practice
  • Sound knowledge and experience of the operations of the capital market, its regulatory and market framework and applicable laws
  • Experience in preparation of reports/legal opinions
  • Experience in compliance functions would be an advantage
  • Experience or exposure to mediation, adjudication and/or arbitration, specifically Award writing skills would be an advantage

  • Excellent written and spoken communication skills in English and Bahasa Malaysia
  • Strong analytical and critical thinking skills
  • Strong managerial and mentoring skills
  • Good interpersonal skills and ability to work in a diverse team
  • Able to work independently and as part of a team, proactive and results oriented
  • Familiar with Microsoft Office applications with experience in working with Excel and PowerPoint applications
